Booking
The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding on all persons stated on the booking form. Each booking will be confirmed by the owner, as soon as possible after receiving the booking form and deposit and only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you and you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed on the confirmation. The remaining balance of the agreed rental cost must be paid 8 weeks prior to your departure. the owners reserve the right to cancel your booking. The reservation deposit will be forfeited.
Security Deposit
Upon signing the rental agreement the Signatory agrees to pay any damage of any kind to the property from the security deposit. This deposit is fully refundable within 14 days of your departure from the property, provided there are no claims made against it. The deposit is due at the same time as full payment (8 weeks prior to arrival). The security deposit is $300. In the event of any excess damage of any kind to the property or excess cleaning costs or excessive use of electricity, (e.g. leaving external doors open with air-conditioning on) which exceed the security deposit the Signatory will be held responsible for all additional costs.
Cancellations
Providing the Owners receive written notice of cancellation not less than 8 weeks prior to the actual departure date, the Signatory will not be liable to pay the full balance the reservation deposit will be forfeited. If cancellation is between 6 - 8 weeks prior to the start of the holiday the Signatory will be refunded 50% of the full balance, 4 – 6 weeks prior to the start a refund of 25% will be made to the Signatory, and up to 4 weeks prior to the start date 10% will be refunded. If in any circumstance the Owner is successful in re-letting the property, the full balance of the final invoice will be refunded.
Responsibilities
The guests are responsible for the property, and are expected to take all reasonable care of it. At the end of the rental period, all equipment, including everything within the villa, all walls, floors and furnishings included, must be left clean and tidy.
Party Size
Everyone occupying the villa must be listed on the booking form including small children. This is Florida State Law and must be adhered to. The property cannot be shared, assigned or sub-let and only the persons shown on the booking form are permitted to stay in the property. No Pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. This property is fully licensed for short-term rental in Florida. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
Smoking/Pets
For the safety and comfort of all our guests smoking is not permitted within the property. No pets are allowed.
Liability
The Owners and the Management Company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodation and all amenities, including the pool is entirely at the user’s own risk. Children must at all times be supervised by responsible adults when using the swimming pool. GLASS is not permitted within the pool area. It is the responsibility of the Signatory to ensure that all safety devises within the property are operational at all times. The Owners or Management Company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, including disputes or any events that are outside our control, including any form of Force Majeure.
Arrival and Departure
The villa will be available for occupancy from 4.00pm on the date of arrival and must be vacated by 10.00am (prompt) on the day of departure. We respectfully ask that guests adhere to these times as 6 hours is needed to ensure the villa is thoroughly cleaned and serviced.
Insurance
All members of the party are advised to be covered by appropriate travel insurance which carries suitable protection against delays and cancellation, and has adequate medical insurance for the U.S.A, and for your luggage and personal belongings.
Force Majeure
As with any holiday, there may be circumstances beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property. Such circumstances are referred to as ‘Force Majeure’. In the event of Force Majeure, the Owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the Owners liability to you in such circumstance, and they shall not be responsible for any other costs connected with any such cancellation, however arising.
Owners Access
The owners or their management company shall be allowed access at any reasonable time during your stay.
Law
This conduct is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.
Code of Conduct
Lake Berkley is a residential Community. Nothing should interfere with the quiet enjoyment of other holidaymakers and residents. Please do not swim, play loud music, or do anything that is likely to inconvenience your neighbours after 22.30p.m. or before 07.30.a.m. In the event that anyone in your party behaves in a way which our Management Company believes is likely to cause danger, distress or annoyance to anyone else within Lake Berkley, damage any property within Lake Berkley, the Owners or the Management Company reserve the right to terminate your let immediately and forthwith. The Owners or their Management Company shall not be responsible for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.
